Terms of Service

These terms are an agreement between you and B-ne Innovations Limited, a company registered in Zambia ("Yanka", "we", "us"), governing your use of the Yanka platform. By creating an account you accept them.

1. The service

Yanka lets a business build an AI assistant, train it on the business's own information, and connect it to WhatsApp and a website chat widget. The assistant can answer customers, capture leads, record bookings, and share payment instructions or a checkout link.

2. Your account and workspace

  • You must provide accurate information and keep your credentials secure. You are responsible for activity in your workspace, including team members you invite.
  • You must be at least 18 and authorised to act for the business you register.

3. Your content and responsibilities

  • You retain ownership of everything you upload. You grant us the licence needed to store and process it solely to operate the service.
  • You are responsible for the accuracy of the information you train your assistant on — its answers to your customers are drawn from your content.
  • You must have the right to message the customers you contact, honour opt-outs, and comply with WhatsApp's Business Messaging Policy and applicable marketing and consumer-protection law (including for broadcasts).
  • You must not use Yanka for unlawful, deceptive, or harmful content, spam, or any activity that risks the integrity of the WhatsApp platform.

4. AI-generated responses

Assistant replies are generated automatically. We design the system to answer only from your content and to hand over to a human when unsure, but AI output can contain mistakes. You are responsible for reviewing orders before confirming payment and for the commitments your business makes to its customers. Yanka is a tool, not a party to your sales.

5. WhatsApp and third-party platforms

The WhatsApp connection is provided through the Meta WhatsApp Business Platform. Your use of it is also subject to Meta's terms, pricing, and messaging limits, which Meta may change. We are not responsible for interruptions caused by third-party platforms.

6. Payments between you and your customers

Money paid by your customers goes directly to you — via your own mobile money or bank account (with manual confirmation) or via your own Lenco account. Yanka never holds your funds and is not a party to those transactions. Disputes between you and your customers are yours to resolve. Lenco payments are subject to Lenco's terms.

7. Plans, credits, and billing

  • Paid plans are priced in Zambian Kwacha and include a monthly allowance of conversation credits. Usage beyond the allowance requires a top-up.
  • There is no automatic card debit: renewals and top-ups are prepaid. When credits run out, the assistant stops answering until you top up (conversations are still received and flagged for a human).
  • Fees already paid are non-refundable except where required by law.

8. Acceptable use

No reverse engineering, reselling without an agency arrangement, security probing, excessive automated traffic, or use of the service to build a competing dataset. We may rate-limit, suspend, or terminate workspaces that break these terms or put other tenants at risk, with notice where practical.

9. Availability and support

We aim for high availability but the service is provided "as is" without warranties of uninterrupted or error-free operation. Support is provided by email at support@b-ne.net.

10. Liability

To the maximum extent permitted by law, our total liability for claims arising out of the service is limited to the fees you paid us in the three months before the claim. We are not liable for indirect losses, lost profits, or the content of AI-generated replies your business publishes to its customers.

11. Termination

You may stop using Yanka and delete your workspace at any time. We may terminate for material breach. On termination, workspace data is deleted per the Privacy Policy.

12. General

These terms are governed by the laws of Zambia, with disputes subject to the Zambian courts. If a clause is found unenforceable, the rest stands. We may update these terms; material changes will be notified in advance to business users.
